Products manufactured by iO HVAC Controls are expressly warranted for one (1) or five (5) years, depending on product, from date of installation to be free from defects in materials and workmanship. iO HVAC Controls’ exclusive obligation under this warranty shall be to supply, without charge, a replacement for any product that is found to be defective within the one (1) or five (5) year period. THIS WARRANTY SHALL NOT OBLIGATE iO HVAC Controls FOR ANY LABOR COSTS. Repair or replacement of the defective product as provided under this warranty is the exclusive remedy of the purchaser. iO HVAC Controls shall not be liable for any incidental or consequential damages for breach of any express or implied warranty on our products, or under any other theory of liability. Except to the extent prohibited by applicable law, any implied warranty of merchantability or fitness for a particular purpose on our products is limited to the duration of this warranty. Some states do not allow the exclusion or limitation of incidental or consequential damages or allow limitations on how long an implied warranty lasts, so the above limitations or exclusions may not apply. This warranty gives specific legal rights, and there also may be other rights that vary from state to state. This agreement shall be governed by and construed under the laws of the State of Indiana and the parties irrevocably consent to the exclusive jurisdiction and venue of the courts in such State.
